WHAT IS THIS NOTICE

This page describes the methods of managing the website regarding the processing of personal data of users who consult it. This is a privacy notice for the protection of personal data, also provided in accordance with Article 13 of the EU Regulation 2016/679 (hereinafter GDPR), for those who interact with the web services of The Newco S..rl., accessible electronically at the following address:

 This notice is provided only for The Newco website and not for any other websites that might be consulted by the user through links.

This notice is also inspired by Recommendation No. 2/2001 that the European data protection authorities, gathered in the group established by Article 29 of Directive No. 95/46/EC, adopted on May 17, 2001, to identify certain minimum requirements for the collection of personal data online. This includes the methods, timing, and nature of the information that data controllers must provide to users when they connect to web pages, regardless of the purpose of the connection.

The purpose of this privacy notice is to transparently provide information about the data collected from the aforementioned website and its related usage methods.

User access to this website may involve the release of information of a personal nature. The Data Controller for this data is The Newco S.r.l., with registered office in Via del Mercato Vecchio 9/11 – 09124 – Cagliari, Italy, represented by its Legal Representative pro tempore.

The personal data of the user are processed by authorized personnel of the Data Controller and by Data Processors specifically appointed and instructed by The Newco as Data Controller or as independent “Controllers,” authorized to access them in accordance with legal provisions, regulations, and standards.

PURPOSE AND METHODS OF PROCESSING

Personal data will be processed through computer/telematic tools for purposes strictly necessary for the consultation of the website www.thenewco.tech, as well as for purposes related and/or instrumental to such consultation.

Such data are processed in an automated form and collected in an exclusively aggregated form for the purpose of verifying the proper functioning of the site, as well as for security reasons.

Personal data provided by users who submit information requests are used solely for the purpose of performing the requested service or performance.

Data processing will occur using tools and methods aimed at ensuring the confidentiality and security of the data, in compliance with Articles 32 and onwards of the GDPR and in accordance with current national regulations.

Specific security measures are observed to prevent data loss, illicit or incorrect use, and unauthorized access.

LEGAL BASIS AND LAWFULNESS OF PROCESSING

The processing of personal data for the above purposes does not require consent as it is necessary to allow the consultation of the website www.thenewco.it.

Personal data provided by users who submit information requests through the form on the Home Page are used solely for the purpose of performing the requested service or performance.

LOCATION OF DATA PROCESSING

Processing related to the web services of this site takes place at the aforementioned office and is carried out only by technical personnel of The Newco, or by authorized parties for occasional maintenance operations.

No data from the web service is communicated or disclosed to third parties.

TYPES OF DATA PROCESSED AND RELATED RETENTION PERIODS

Navigation data

The computer systems and software procedures used for the operation of this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols.

These are pieces of information that are not collected to be associated with identified individuals, but which, by their very nature, could allow for the identification of users through processing and association with data held by third parties.

Data provided voluntarily by the user

Cookies

No personal data of users is acquired by the site in this regard.

No use is made of cookies for the transmission of personal information, nor are systems used to track users.

The use of session cookies (which are not persistently stored on the user’s computer and disappear upon closing the browser) is strictly limited to the transmission of session identifiers (consisting of randomly generated numbers by the server) necessary to allow secure and efficient exploration of the site.

NATURE OF PROVISION AND CONSEQUENCES OF REFUSAL

Apart from what is specified for navigation data, the user is free to provide personal data to The Newco through the request forms or any other contact with The Newco to request information about the products and services offered by The Newco.

Therefore, the refusal to provide mandatory data will objectively make it impossible to pursue the processing purposes described in this Notice and to obtain what is requested.

It should also be noted that in some cases (not part of the ordinary management of this site) the Authority may request information and information for the purpose of monitoring the processing of personal data. In these cases, the response is mandatory under penalty of administrative sanctions.

RIGHTS OF THE DATA SUBJECT

According to the GDPR, you have the following rights as a Data Subject that you can exercise against The Newco:

a) the right to obtain from the Data Controller confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data and the information listed in Article 15 of the GDPR, particularly those regarding the purposes of the processing, the categories of personal data concerned, the recipients or categories of recipients to whom the personal data have been or will be disclosed, the retention period, etc.

b) the right to obtain the rectification of inaccurate personal data concerning you and to have incomplete personal data completed, always in relation to the purposes of the processing (Article 16);

c) the right to erasure of data (“right to be forgotten”), if one of the cases referred to in Article 17 applies;

d) the right to restriction of processing, in cases provided by Article 18;

e) the right to data portability pursuant to Article 20;

f) the right to object to processing pursuant to Article 21;

 g) the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal, only for purposes where the legal basis is consent (Article 7).

Finally, please note that you have the right to lodge a complaint with the Garante per la Protezione dei dati personali (Italian Data Protection Authority) or another supervisory authority pursuant to Article 13, paragraph 2, letter d) of the GDPR.
